NEW POLL: California Ballot Measure Capping Billboard Lawyer Payouts — Has 78% Support and Only 12% Oppose

California voters agree lawsuit abuse is driving up costs, say it’s important to limit the fees lawyers receive in auto accidents; support climbs nearly 20 points since December

Competing trial-lawyer-backed rideshare liability measure tenuous and falls below 50% once voters learn more

SACRAMENTO, CA — A More Affordable California (AMAC) today released new polling from David Binder Research showing that California voters overwhelmingly support a ballot measure to cap billboard lawyer settlements and guarantee protections are put in place for accident victims. Support for the measure now stands at 78% in favor to just 12% opposed– a nearly 20-point increase since December 2025.

The polling, conducted across two surveys of likely November voters, also found that support holds strong even after voters are exposed to opposition messaging, putting the measure in a strong position heading into November.

Voters are directly linking lawsuit abuse to the affordability pressures squeezing households:

  • 73% of voters say lawsuit abuse is driving up the cost of auto insurance for California families
  • 71% of voters say lawsuit abuse is driving up the cost of goods and services for California families
  • 66% of voters say it is important to limit the fees lawyers receive in auto accident cases

“The cost of living is poised to be one of the defining issues of the 2026 election cycle, and California voters are connecting lawsuit abuse directly to the affordability pressures they face every day,” said David Binder. “New polling shows broad agreement that lawsuit abuse drives up the cost of goods, services, and auto insurance, while two-thirds of voters say it is important to limit the fees lawyers receive in auto accident cases.”

AMAC also tested support for a competing ballot measure to expand liability on rideshare companies. Support for the measure is tenuous and drops below 50% after voters hear messaging about it. 73% of respondents say it is a convincing reason to oppose the measure when they learn that the Consumer Attorneys of California, the measure’s funders, are themselves funded by the Downtown Law Group, currently under criminal investigation for allegedly filing false sex abuse claims against LA County. Only 45% of voters said they would support the measure after hearing this information, well below the 50% required to pass.
